Adam McDaniel. My understanding is that, on October 5, 2010, United States Attorney Wifredo Ferrer appealed to DAAG Margolis OPR’s recommendation that a finding of misconduct be made and also OPR’s recommended sanctions. From speaking with DAAG Margolis, I understand that he referred the matter to you for review. I am writing to determine the status of your review, and also to ask whether you would permit AUSA | and I to make a presentation to you regarding why we believe that OPR’s recommendations are erroneous. Although we requested the opportunity to make such a presentation to U.S. Attorney Ferrer, he determined that such a presentation was not necessary in deciding to appeal OPR’s recommendations; thus, AUS A J has yet to present her position to a reviewing official. It is our understanding that DAAG Margolis has set a short time frame for review of OPR decisions once they have left the U.S. Attorney’s Office, and we do not want to forego the opportunity to present our position if you believe it would assist you in making your decision.
