From: Paul Cassell To: Ce: Subject: Epstein's Position on section 2255 Date: Tue, 09 Mar 2010 19:05:01 +0000 Importance: Normal Attachments: epstein-2255-sj.pdf 1 | wanted to call to your attention this recent filing by Jeffrey Epstein in one of the civil cases against him. As you will see, in part Il of his summary judgment motion, he argues that only a victim who is currently a minor (i.e., only one who is under the age of 18 today) can seek civil relief under the federal statute, 18 USC 2255. This position, to put it mildly, seems somewhat at odds with the position that Epstein is expected to take under the non-prosecution agreement. If accepted, it would mean that NONE of the victims listed in the non-prosecution agreement would be able to pursue relief under section 2255. | wanted to call this inconsistency to your attention and request that you enforce Epstein’s obligations to his victims under the non-prosecution agreement. Thanks in advance for your help on this issue. Paul Cassell Paul G. Cassell Ronald N. Boyce Presidential Professor of Criminal Law S.J.
